Federal Robbery (Hobbs Act)/Federal Gun Possession - Southern District of New York

Client was charged with shooting at a federal confidential informant following an attempt by him and a co-defendant to commit a robbery. The client was facing a possible jail sentence of 13 years if convicted. At trial, before the Honorable Jeb Rakoff, the co-defendant testified on behalf of the government and against Sullivan & Brill's client. After a week long trial and a 5 days of jury deliberation, the jury informed the court that they were deadlocked and could not reach a verdict. The judge declared a mistrial and rescheduled a retrial. In the interim, Sullivan & Brill, LLP engaged in intensive negotiations with the government as was able to work out a plea where their client would be sentenced to a little more than 4 years.
