CLIENT CHARGED IN THE SDNY WITH CONSPIRACY TO IMPORT ILLEGAL PHARMACEUTACALS INTO THE UNITED STATES AND RECEIVES NO JAIL TIME
Steven Brill from Sullivan Brill was retained to represent a businessperson who owned and operated a pharmaceutical company in India specializing in exporting home health care products and cosmetics internationally. According to the government, they started the investigation from an investigation by the Drug Enforcement Administration (“DEA”) into major international traffickers of Tramadol, a controlled substance in schedule IV and began investigating several pharmaceutical laboratories based in India that are responsible for manufacturing and sending containerized shipments of Tramadol from India to other parts of the world including the middle east. Under the Federal Sentencing Guidelines, if Brill's client was convicted of the crimes charged, he was exposed to close to 5 years in jail. Sullivan Brill's client was lured here by a government sting operation arrested on these charges, and held in home confinement while the case proceeded.
Steven Brill was able to persuade the SDNY Judge to lift the home confinement restriction so that his client could move around freely while here in New York. In the end, Steven Brill worked out a plea agreement with the government where his client pled guilty to the less serious count on the indictment. At sentencing, Brill convinced the Judge to sentence his client to time-served. On top of that, successful result, the Court permitted the client to self-deport and not be taken into ICE custody, so he could travel back to his home in India on his own.
